Will of John Doe
I, John Doe, a resident of the county of Smithville, state of New Jersey, declare this my last Will. I revoke any Wills and Codicils made previously.
ARTICLE I DECLARATION I am married to Jane Lynn Doe. I further declare that all provisions in my will relating to my spouse and their relatives are to be in effect unless we become divorced.
ARTICLE II BEQUESTS I have not made any bequests of specific gifts or cash at this time. If I leave a signed letter or memorandum in the future requesting that specific articles of tangible personal property be given to named individuals, I ask that these bequests be honored in addition to those listed in this instrument. If someone I gave a memorandum or letter predeceases me, then that specific bequest shall lapse.
ARTICLE III GENERAL DISPOSITION OF MY PROBATE ESTATE I leave the remainder of my estate to my spouse Jane Lynn Doe if they survive me. If my spouse does not survive me or is unable to receive my estate, I leave the remainder of probated property to Tom Smith. If Tom Smith does not survive me or is unable to receive my estate, I leave the remainder-probated property to Steve and Susan Jone.
ARTICLE IV APPOINTMENT OF EXECUTOR I appoint my spouse Jane Lynn Doe to be the Executor of my estate if they survive me. If Jane Lynn Doe does not survive me or ceases to act as my Executor, I appoint Tom Johnson to be the Executor of my estate. If Tom Johnson fails or ceases to act as my Executor, I appoint Steve and Susan Jone to be the Executor of my estate.
ARTICLE V CLAIMS, EXPENSES & TAXES My Executor shall be authorized to carry out all provisions of this Will. I further authorize my Executor to pay all claims allowable against my estate and authorize my Executor to pay all reasonable expenses incurred administering my estate. It will be the responsibility of my Executor to pay all estate, inheritance and any other taxes assessed against my estate.
WITNESSED I, John Doe, do hereby declare to the undersigned witness that this is to be my last Will. Signed, sealed, published and declared by John Doe, the Testator above named, to be the Last Will in our presence, and we, all of whom were present at the same time, do hereby attest to the sound mind and believe to be of legal age of the testator. By signing below, each of us affirm that we are of legal age, free of undue influence and are in the presence of the testator and the other witnesses.
